i ethical bought a brand new LG x130 netbook and it does not charge, the retailer told me that it is due to me upgrading the OS from Windows Xp to Windows 7. Is it constant???

No, certain rubbish! The operating system has no effect whatsoever on the condition of the battery. Sounds to me like he's bothersome to get out of replacing a faulty battery. Go back and tell him to exchange it.
